GSIEDA Terms of Service

 

In order to protect your rights, please read all the terms and conditions of the Global Sustainable Innovation & Education Development Association (hereinafter referred to as GSIEDA) before registering or using this service. After you check or click Agree, it is deemed that you have read the user terms and agreed to abide by all of the following content. If you are a minor under the age of 20, you should be accompanied by a parent (or legal representative) to read, understand, and agree to all the contents of the user terms before you can continue to register, log in, and use this service. When you register, log in, or use this service, it is deemed that your parents (or the legal representative) have read, understood and agreed to accept all the following content (including revisions and changes), and agree to your registration, login, and use of this service.  If you and/or your parents (or legal representative) does not agree to any of the terms, you shall stop using this service immediately. 

General Conditions

1. GSIEDA website members

(1) If you wish to use the various services (hereinafter referred to as "the service" of the GSIEDA website (URL: https://www.gsieda.com/), you must log in, register or agree to all the terms and conditions on the GSIEDA website and the GSIEDA's special provisions (including but not limited to user terms, privacy policies, intellectual property rights and reporting policies, etc., collectively referred to as "the terms"). If you do not agree to any content of these terms, please stop logging in, registering as a member or using this service immediately. If you continue to log in, register or use this service, you are deemed to know and agree to fully comply with all the content of the terms.

(2) You are not allowed to transfer, lend, pledge, create encumbrance, sell, lease or otherwise transfer or dispose of all rights and content obtained through membership or the use of this service to others or share them with others.

2. Register account and information

(1) You agree to abide by the terms and become a member, and after completing the login and registration procedures, you will be eligible for membership.  However, the GSIEDA may reject, restrict or approve your membership application and/or the scope of the use of this service at its discretion. For example, there have been members whose membership has been cancelled or suspended in the past by the GSIEDA, or whose behaviors are determined by the GSIEDA to be inappropriate. The same treatment will apply if the GSIEDA finds the abovementioned circumstances after you have passed membership application.

(2) When you log in and register, you should fill in your correct, up-to-date and complete information, and maintain and update your member information at any time thereafter.  You, not the GSIEDA, shall bear responsibility for any unfavorable results or risks arising from your failure to modify or update the membership personal information in a timely manner. All communications and activities between the GSIEDA and you are solely based on the latest member profile contained in your GSIEDA website account at the time. You must not fake another person's identity, or register or log in to a member account for another person, or use an account or name that can be easily misunderstood as a sign of another person’s registered trademark or product or service, government agency, enterprise or other GSIEDA, or related to the GSIEDA website. If there is a violation, in addition to the handling procedures of the terms, the GSIEDA may revoke, withdraw, suspend, abolish, transfer or force renaming your account or name at its discretion, and you shall have no objection. 

(3) The member account of this service is bundled to one of your email boxes, and one email box can only apply for one member account. After your member account is bound to the email box, you cannot change the bound email address. You cannot transfer to or share the member account (or all or part of its content) with your other email addresses or member accounts, so please carefully select the email address to be bound with your account when registering. The membership account of this service is for your personal use only, and cannot be handed over to or shared with others.  If you have multiple member accounts, please note that the electronic files purchased or obtained through one of the member accounts, membership upgrades (defined in Article 14 below), and other value-added content or special services, etc., are limited to that member account. You cannot share or transfer the aforementioned electronic files or membership upgrades to other member accounts.

3. You agree that your User Content (as defined in Paragraph 3 of Article 8 below), GSIEDA account information and the information created, entered, presented, submitted or provided in any way when using the GSIEDA website services can be synchronized with all platforms used by all accounts. In order to conduct the abovementioned platform synchronization, the GSIEDA may access, reproduce (part of all), openly transit, broadcast, dictate and display, modify, distribute, process and/or adopt other ways to use the abovementioned content, data, and information. Account security

(1) Please keep the account number and password of your member account properly, and it is recommended that you change the password regularly to prevent account theft. You are responsible for all activities in your member account.  When the account number and password entered on the GSIEDA website are consistent with your login registration information, whether the account number or password is entered by you personally, they will be regarded as your personal login and use, even if they are stolen or improperly used or in other circumstances where the GSIEDA cannot identify whether you use the account personally. The GSIEDA shall not be liable for any loss or damage caused.

(2) If you find or suspect that your account and password have been stolen or improperly used by a third party, or have any security concerns, please take the initiative to notify the GSIEDA immediately to take appropriate countermeasures.

4. Account suspension and termination

(1) If the GSIEDA or the GSIEDA website system detects that your account has been inactive for a certain period of time, the GSIEDA or the GSIEDA website may remind you whether you will continue to use the account. If you do not reply within a deadline or log in to use, the GSIEDA and the GSIEDA website system have the right to determine that your account is unused for a long time and automatically delete, revoke or cancel the account and all User Content and files stored and related data, and it will not be backed up separately. All records of your login, use or activity under your GSIEDA website account are solely based on the records kept in the GSIEDA website system platform. 

(2) The GSIEDA may suspend, terminate or revoke your membership and/or the right to use all or part of the service without prior notice when the following conditions are met, and shall not be held liable:

  1. Your behaviors using the service have violated laws or regulations or provisions of the terms, or the GSIEDA considered that there is a risk of infringing on other people's rights or inappropriate behaviors.

  2. Other conditions for which the GSIEDA considers to take these actions based on the reasonable judgment.

(3) If your membership qualification and/or all or part of the rights to using the service is suspended, terminated or revoked by the GSIEDA, or the account content and data is deleted based on this article, you may not request for refund. However, if your membership qualification is suspended, terminated or revoked due to Subparagraph (i), Paragraph (2) of this article, and you can provide evidence to prove to you have not violated rules or infringed on other people's rights, you can apply to the GSIEDA for review.

5. Member code of conduct

(1) You agree to abide by the following matters when using the service:

  1. Comply with the content of the terms.

  2. Comply with all applicable laws and regulations and instructions of competent authorities of the United States of America.

  3. Never use the service for any illegal purpose or in any illegal way, and will not use the service to infringe on the rights of the GSIEDA and people (including the privacy, reputation and intellectual property rights of the GSIEDA and others).

  4. Will not post, distribute or upload any defamatory, insulting, threatening, offensive, provocative, indecent, obscene, untrue or false news or rumors, or content or files of blood and gore, violence, incitement to crime, illegal or violation of public order and good social customs.

  5. Will not violate your confidentiality obligations under the law or contract.

  6. Will not fake other people's identity or spread false information.

  7. Will not engage in GSIEDAal politics, party activities, or activities that are not directly related to GSIEDA, learning, online education or the GSIEDA.

  8. Without the prior written consent of the GSIEDA, you will not spam advertising emails, post advertising articles, sell goods, or use GSIEDA or the service to engage in commercial or profit-making activities.

  9. Will not engage in other actions that the GSIEDA has announced or notified you as inappropriate.

(2) You agree that the GSIEDA has the final right to determine whether your behaviors comply with the above regulations. If the GSIEDA believes that your behaviors violate the above regulations, the GSIEDA or the GSIEDA website may immediately delete the content or files suspected of violating the above regulations, and handle the matters in accordance with the other provisions of the terms, and you will bear the relevant legal responsibilities. You agree that the use of your account to publish or transmit content or to act on the GSIEDA website represent your personal position, and agree to bear all responsibilities, and the GSIEDA is not to be involved.

6. Payment

At present, the membership registration of the service and/or the provision of part of the service content are free, but the GSIEDA may change the membership registration or part or all of the service to a fee-based system in the future depending on commercial needs, and will notify you in accordance with Article 11. Service-related fees are paid through third-party payment or electronic payment platforms certified by the competent authority, including but not limited to Apple Pay, Google Pay, or other third-party or electronic payment platforms with which the GSIEDA collaborates. When you click online payment option, you will leave the GSIEDA website and enter the payment platform set up by the third party or electronic payment platform. The GSIEDA and the GSIEDA website will not acquire or store your payment information unless you have agreed to it in advance and provided it voluntarily. 

7. Interruption or suspension of the service

The GSIEDA may interrupt or suspend the provision of the service or the use of your account without prior notice when any of the following conditions is met, and shall not be held liable:

(1) The GSIEDA conducts routine or emergency relocation, replacement, upgrade, backup, maintenance or repair of related software and hardware systems and equipment.

(2) Emergency or unexpected accidents resulting in system equipment failure or overload, or hindrance to the operation of the service content or other similar situations.

(3) Behaviors of a third party, power, network or server service interruption, natural disasters, force majeure, or other reasons that are not completely controlled by the GSIEDA or are not attributable to the GSIEDA.

(4) When there is any reason causing the GSIEDA to suspect that your account may be stolen or abused (such as when the account payment information cannot be verified, or the password or account number has been entered wrong multiple times in a short period of time).

(5) Other conditions for which the GSIEDA considers to take these actions based on the reasonable judgment.

8. Intellectual property statement and use restrictions

(1) The copyright, patent rights, trademarks, trade secrets, other intellectual property rights, ownership or other rights of all works and materials available on the GSIEDA and the GSIEDA websites and the service are owned by the GSIEDA or its right holders. Unless otherwise legally authorized by the GSIEDA or its right holder, you may not reproduce, transmit, modify, edit, or use them in any other form or for any purpose, as you will be liable for related infringement and compensation.  The terms do not have any regulations that transfer or grant you any intellectual property rights owned by or authorized to the GSIEDA.

(2) Without the prior written permission by the GSIEDA, you may not use all or part of the information of the website or content the GSIEDA or the GSIEDA in any other form or method beyond the scope of the permission or in abnormal use, including but not limited to modification, duplication, distribution, design, reproduction, re-distribution, download, display, publication, transmission, sales, data mining or similar data collection or extraction methods of the abovementioned content of publications and data on the websites of the GSIEDA and the GSIEDA. If you have the abovementioned behaviors, you must pay punitive penalty US$1 million (if the illegal sales amount exceeds US$1 million, the penalty shall be ten times the sales zmount). You shall also compensate the GSIEDA for any other losses and damages suffered by the GSIEDA.

(3) The copyright or other intellectual property rights of all the works and materials created, stored and used by you in this service or the content or other materials submitted to GSIEDA, including but not limited to published questionnaires or e-mails sent to the GSIEDA (hereinafter collectively referred to as "User Content"), are still owned by you or other legal rights holders, but you must guarantee that the User Content does not violate laws or infringe on the rights of third parties, or the GSIEDA will handle the matters in accordance with the intellectual property rights reporting policy. With regard to the User Content that you upload, store or publish on the GSIEDA website, whether you choose to make it public to or share it with an unspecified third party, you agree to authorize the GSIEDA free of charge to store, publish, use, duplicate, process, adapt, modify, publish, transmit, display, and distribute such User Content of information throughout the world on a permanent, non-exclusive, transferable and sublicensing-enabled basis, and you hereby declare and guarantee that you have all necessary rights with respect to the aforementioned User Content, and are sufficient to effectively grant the aforementioned authorization to the GSIEDA. 

(4) The service includes the use of embedded links or other appropriate methods deemed necessary by the GSIEDA to allow other websites and applications (hereinafter collectively referred to as "third-party websites") to search for, obtain, and use the information. With respect to the content on third-party websites produced internally by the third-parties for which the GSIEDA has not been granted any rights, the GSIEDA is not the author and will not review any content on the third-party websites. Please use it at your discretion and judgment. The GSIEDA will not be held liable for the third-party websites and applications. You will be solely responsible for the losses or risks with the use of such third-party websites or applications. Unless otherwise announced by the GSIEDA, there is no employment, agency, appointment, partnership or other similar relationship between the GSIEDA and third-party websites. 

(5) You shall not do the following:

  1. Collect, access, handle or use any information that is not for your use and/or functions that are not available from the GSIEDA website, the GSIEDA website or the service for your use, including the personal data, account passwords, accounts and passwords and content of other users on the GSIEDA website, and e-books that you are not authorized to read or access.

  2. Use any deep linking, web scraping, bots, SPIDER or other automated device, program, algorithm or method, or other similar or equivalent manual procedures to access, acquire, duplicate or monitor any part of this service content, or use any ways to reproduce or circumvent the structure or presentation of this service to obtain or attempt to obtain any data, documents or materials that are not designed and provided by this website.

  3. Spread computer viruses, net-worms, Trojan horses or other malicious programs to paralyze the GSIEDA website, the GSIEDA’s website or the service through network traffic or transmission, or cause excessive load on the system, or have any behaviors that can possibly or sufficiently interfere, interrupt or affect the normal provision of the GSIEDA website, the GSIEDA's website or the service.

  4. Crack or circumvent or interfere in any way with GSIEDA website's measures to prevent or restrict the use of all or part of the services, or try to obtain any of the source code or program code of the GSIEDA website, the service, the GSIEDA's website or related programs through decoding, deciphering, decompiling, reverse engineering or other methods.

  5. Detect, scan or test any vulnerabilities in the GSIEDA website, the service system and the GSIEDA’s website, or invade, access or tamper with any computer systems or platform areas and the relevant data of ​​the GSIEDA website, the service and the GSIEDA’s website that are not open to you, or engage in other acts that infringe or attempt to infringe on information security.

  6. Use or duplicate the trademark, intellectual property rights or copyrights of the GSIEDA website, the GSIEDA, or its affiliates without the prior written consent of the GSIEDA, or remove, obscure or change labels or declarations of trademark, copyright or intellectual property rights.

  7. Cover up or tamper with your geographic location, forge titles, use proxy servers, use IP scams or other methods to manipulate identification data to disguise the origin of any data you upload or download through the service.

  8. Have behaviors that are in violation of law, public order and good social customs, or other behaviors which the GSIEDA has announced or notified you to stop.

9. Limitation of liability and disclaimer

(1) All websites, applications, services and digital content (including but not limited to search results or links to third-party websites or Internet resources) published or provided by the GSIEDA website, the service and the GSIEDA are in "status quo" or "as is". The GSIEDA does not assume any responsibility for express or implied warranty, and does not guarantee that its content is free of defects or does not contain computer viruses, malicious programs and other harmful programs, or that the transmission and storage of data can be correctly performed without interruption. The GSIEDA also does not guarantee that you will obtain any specific results by using the aforementioned GSIEDA website and the service or other digital content provided by the GSIEDA. You shall bear the risks and losses arising from your use of the GSIEDA website, the service, and websites, applications, services and digital content published or provided by the GSIEDA. 

(2) You should back up and store all User Content and data uploaded, provided or stored on the GSIEDA website on your own. The GSIEDA and the GSIEDA website may periodically or automatically transmit and back up the User Content and data stored by the member at its discretion or in accordance with the method and processing capacity set by the GSIEDA website at the time. However, the GSIEDA and the GSIEDA website does not guarantee that the User Content and data can be successfully transmitted, uploaded or backed up, and the GSIEDA is not responsible for the failure to backup, delete, upload or save User Content and data.

(3) Unless otherwise specified in the terms or mandatory regulations, the GSIEDA is not responsible for any of your losses and damages.

10. Breach of obligation

If you violate the laws or regulations or breach any part of the terms, further causing damages or expenses to the GSIEDA or its affiliates, employees, trustees, agents and other related performance assistants (including litigation and attorney fees), you shall be liable for damages.

11. Modification and notice of the terms and service content

(1) The GSIEDA has the right to change, modify, update, cancel, revoke or terminate all or part of the terms and the content of the service at any time.

(2) The modification of the terms and the service content and the supplement of rules and conditions, etc. are announced on the relevant pages of the GSIEDA website. The GSIEDA has the right but not the obligation to notify members separately by email. Please pay attention to the relevant information on the GSIEDA website. Unless otherwise specified by the GSIEDA, the revised terms or service content will take effect once announced or members are notified (whichever is earlier). If you continue to use the service after the revision of the terms, you are deemed to have agreed to the revised content.

(3) All notices sent to you by the GSIEDA in accordance with the terms can be announced on the relevant pages of the GSIEDA website or sent to the e-mail address you used to register your membership account, whichever works better.

12. Partial invalidity

If any clause or provision of the terms is invalid, illegal or unenforceable under the current law, other clauses or provisions shall still be valid and will not be affected.

13. Governing law and jurisdiction of the court

The terms and the relevant regulations and agreements of the service adopt the laws of the country or region to which they belong. For disputes related to the terms, you agree to use the laws in Taiwan as the proper law and San Francisco District Court as the court of first instance.

Upgrade of Membership (Subscription System)

14. Upgrade membership qualification

(1) The GSIEDA may offer its members the following methods (hereinafter referred to as "Membership Upgrade"): to pay for upgrade of the account functions:

  1. After the trial period for membership upgrades provided by the GSIEDA expires, the member agrees to pay the renewal fee. [Please note that if you do not voluntarily cancel the membership upgrade after the trial period expires, the system will automatically renew the upgraded membership, and you will be automatically charged the relevant fees according to the GSIEDA's current charging plan starting the next day after the trial period expires.  The GSIEDA will remind you by email that the contract will be automatically renewed and of the related charging plans 3 days before the expiration of the trial period. ]

  2. Pay the membership upgrade-related fees in advance.

(2) After the membership is upgraded, you are entitled to more other preferred specials during the upgrade period compared with ordinary members. The specific content depends on the announcement made by the GSIEDA at the time.

(3) Please note that the membership upgrade services provided by the GSIEDA are digital content or online services that are completed once provided, and are subject to Article 2 of "The Regulations on Reasonable Matters as Exceptions to Rescind the Distance Sales". The right to rescind the contract of services as stated in Paragraph 1, Article 19 of the Consumer Protection Act does not apply, and you cannot request a refund from the GSIEDA after the payment is made. However, if the membership upgrade fee paid by you covers a certain period of time (such as monthly payment), and you wish to terminate the applicable contract as agreed (if specified previously) or terminate the contract in advance in accordance with the terms, the GSIEDA will issue a pro-rated refund.

(4) The GSIEDA reserves the right to adjust the price of membership upgrades from time to time, and the price change will take effect from the announcement date.  However, if your membership upgrade period has not expired when the price change takes effect, the adjusted price will be applied only when you renew or agree to it.  The GSIEDA will notify you in advance of the price change and its billing method before adjusting the price. [If your membership upgrade adopts the automatic renewal and charging methods, and after the price adjustment takes effect (or your original membership upgrade period expires), you do not take the initiative to inform the GSIEDA to cancel, and continue to log in and use your upgraded membership, it is deemed that you have agreed to the adjusted price offered by the GSIEDA.  If you do not agree with the price adjustment, please be sure to notify the GSIEDA to cancel your membership upgrade before the price adjustment takes effect (or before your original membership upgrade period expires). ]

E-books and Learning Materials

15. Use and purchase of e-books and learning materials

(1) The copyright and copyright of the e-books, materials, digital publications or other works (hereinafter collectively referred to as "e-books") provided by the service and the GSIEDA website belong to the GSIEDA, authors, and licensors.  The e-books that you purchase, download or obtain through a specific account are only available to you for download and access, and may only be used for your personal non-commercial use, and may not be used for any other purpose. The whole content or part of the content shall not be modified, transmitted, published, transferred, sold, reproduced, recreated for product extension/ derivative, distributed, performed, displayed or used in any way.

(2) You can purchase, access, view, download, store and read e-books, and use and access specific functions after logging in to the GSIEDA website account through different devices that you own (please refer to the specifics of the service and the GSIEDA website provided at the time). The fees, scope and period of trial reading and user functions of e-books download provided by the service are subject to the information shown on the GSIEDA website and the announcement made by the GSIEDA (including the subsequent changes). If the e-book you download or access has an expiration date, please note that you will not be able to access, download or read the e-book after the period expires, and the e-book originally downloaded or stored to your account may also be automatically deleted by the GSIEDA website system.

(3) You understand and agree that the GSIEDA website only serves as a platform to provide e-books. Every e-book is provided in existing condition and as is. The GSIEDA has not conducted substantive review of the content of e-books, nor has it provided any guarantees for the authenticity, legality or infringement. Users should make their own prudent judgments and bear all losses and risks for such content. The GSIEDA does not bear any responsibility for the content.

(4) Please note that the e-book service is linked to your specific member account. If your account or its membership is suspended, terminated or revoked for any reason, the books purchased, stored or accessed through the account may become unavailable for access, reading or use.

(5) Please note that the e-books you purchase are digital content or online services that are completed once provided, and are subject to Article 2 of "The Regulations on Reasonable Matters as Exceptions to Rescind the Distance Sales". The right to rescind the contract of services as stated in Paragraph 1, Article 19 of the Consumer Protection Act does not apply, and you cannot request for refund after the payment is made.

(6) Except for the following circumstances, the learning materials and e-books you obtain through your account are restricted to your personal reading and reasonable use, and may not be distributed, reproduced or shared with or transferred to third parties. 

User Forum

16. Forum and administrator authorization

The GSIEDA may add message boards, discussion areas, or other network areas (collectively referred to as "forum") where members can freely post and discuss on the GSIEDA website. The GSIEDA may appoint administrators (referred to as "administrators") to manage the forum, and, within the scope of business management, grant administrator the authority to manage the forum of the GSIEDA. You agree that within the scope of forum management, the administrators may edit, delete, modify or site your publicly published User Content in the forum or include it in an appropriate place in the forum, and retain your account number or other labels that can identify you.

17. User behaviors

(1) You are held responsible for any User Content or information posted by you publicly or transmitted privately.  The GSIEDA cannot control and review the User Content you provide, upload, and store through the service, so the GSIEDA does not guarantee the correctness, completeness or quality of such content.

(2) You understand that when you use this service, you may encounter other unpleasant, inappropriate, and offensive User Content.  Under any circumstances, the GSIEDA is not responsible for any User Content, nor is it responsible for any loss or damage arising from such content.

(3) You understand that the GSIEDA has not reviewed User Content in advance. However, the GSIEDA has the right (not the obligation) to reject or remove any User Content based on business considerations.

(4) The GSIEDA has the right to remove User Content that violates the terms and the GSIEDA's other policies.

Privacy Policy

When you use the GSIEDA website, the collection, handling and related use of personal data involved are protected by the privacy policy.  The "collaborating enterprises" in the terms include, but are not limited to, publishers or companies that authorize the works or digital publications on the GSIEDA website, e-books or the GSIEDA's website, and other vendors or individuals that provide goods or services related to the GSIEDA website.

18. Notification of collection, handling and use of personal information

(1) In order to ensure the protection of your personal data, privacy and consumer rights, the GSIEDA notifies you of the following matters in accordance with Article 8 of the Personal Information Protection Act when using your personal data:

  1. Collection entity: The GSIEDA and its collaborating enterprises

  2. Purpose of collection: Include marketing, contracts, similar contractual or other legal related matters, internal management of membership or other member lists, consumers, customer management and services, consumer protection, statistics, research and analysis, and other operations specified in the business registration items or the articles of incorporation, and other businesses related to the GSIEDA or the service.

  3. Personal data categories: The collected information includes the following which can identify individuals, such as the member’s name, address, phone number, email address, and, when logging in with Google, Facebook, Yahoo, Line, Twitter, WeChat or other third-party online accounts, the information provided by those third parties.

  4. Period, region, related party and method of the use of personal data: During the operation of the GSIEDA, your personal data may be used in the regions of Republic of China(Taiwan), the United States, and other foreign regions where the GSIEDA's servers or backup servers are located. The GSIEDA and/or its collaborating enterprises may handle and use your personal data electronically or by paper within the scope of collection per your agreement.

(2) The backend of the GSIEDA website system will collect and compile uses, records of learning history, and other data and information generated by login or the use of the GSIEDA website, and use it for statistics, analysis and research conducted internally or by collaborating enterprises. The processed data after compilation is anonymous or big data, which cannot identify specific natural persons, so your personal data will not be leaked.

(3) The GSIEDA website collects IP address information when you access the GSIEDA’s server, and this is for the purpose of authenticating your access to the GSIEDA’s website, investigating your access history and usage, and improving the service quality to you. When you access the website with a mobile phone, the GSIEDA collects the relevant data of the mobile equipment identity and uses the technology of cookie to collect your access records and other relevant data, and obtains the ownership of the aforementioned data.

(4) The provision of this service is subject to your agreement to accept the provisions of the privacy policy and cookies.  If you refuse to provide the necessary information required by the service, please be aware that you may be restricted or refused to use the various functions of the service.

19. Handling members' personal data

(1) The GSIEDA handles and collects personal data in accordance with this privacy policy, and you also agree to abide by the privacy protection policy to use the services provided by the GSIEDA.

(2) Your personal identification data is used for specific purposes and will not be leaked to a third party, unless the following circumstances are met:

  1. You have agreed to it in writing (including the use of electronic signature or digital signature).

  2. When your behaviors violate the terms, or hinder the normal operation of the GSIEDA website or system, or are likely to harm the rights of the GSIEDA or anyone, and the data is required for identification, contact, or legal actions.

  3. Needed in order to comply with laws and regulations or per the request of judicial or government agencies.

  4. To maintain the operations and security of the GSIEDA website or system, or to improve related products or the service.

(3) When the GSIEDA or the service is completely or partially split, or acquired by other third parties, or the GSIEDA's assets are acquired, resulting in ownership transfer, the GSIEDA will announce the relevant details on the website in advance, and that all or part of members' data owned by the GSIEDA or the service may also be transferred to a third party under the ownership transfer. However, this applies only to the personal data related to the ownership transfer.  If part of the operations of the GSIEDA and the service is transferred to a third-party, you are still a member of the GSIEDA. If you do not want the GSIEDA to use your personal data in the future, you may exercise your rights in accordance with the privacy policy.

(4) You have the following rights to your personal data in accordance with the law, but the GSIEDA may charge appropriate fees:

  1. Request for inquiry or reading.

  2. Request for duplicate copies.

  3. Request for filling in omission or correcting errors.

  4. Request for stopping collection, handling or use of data.

  5. Request for deletion.

Policy on Reporting Violation of Intellectual Property Rights

20. If any content on the GSIEDA website or the service involves infringement of your intellectual property rights, please specify the following matters, have the owner (or the agent) of the intellectual property rights sign or apply the personal seal, and notify the GSIEDA for further handling:

(1) The relevant certification documents of the intellectual property owner (or its agent) and the content of the rights, such as the infringed work or the name of copyrights.

(2) Content suspected of infringing your intellectual property rights, or the relevant information and the access path sufficient for the GSIEDA to learn of the infringement.

(3) Contact information such as your name or title, address, telephone, fax and e-mail address.

(4) If you provide the notification as an agent, you should also declare that you have been appointed by the intellectual property right owner and state the name of the intellectual property right owner.

(5) A written statement showing that you in good faith believe that the infringed content or use is not legally authorized by the intellectual property owner (or its agent), and request the GSIEDA to remove the infringed content or make it unavailable for others.

(6) A written statement showing that the relevant information stated in your notice is true, and that you are the intellectual property right holder (or its agent) . If the information false, you are willing to bear all legal responsibilities.

21. If your notice does not meet the requirements of the preceding article, the GSIEDA may, within 5 working days from the day after receiving the notice, notify you to supplement the missing information and documents in the same manner as you originally notified the GSIEDA. You should supplement the correction within 5 working days from the day after receiving the notice for correction sent by the GSIEDA. If you fail to make corrections by the deadline or the supplementary materials are insufficient, it shall be deemed that you have not submitted a notice of infringement to the GSIEDA.

22. The infringement notice under the Policy on Reporting Violation of Intellectual Property Rights should be submitted in writing or electronically signed documents by email to GSIEDA.com@gmail.com, or mail them to 350 Townsend Street, Rm.  770, San Francisco CA

23. After receiving the notice, the GSIEDA will forward your notice to the party suspected of infringement by email or other methods as soon as possible, and ask the party to reply within 3 working days. If the party fails to reply within 3 working days, the GSIEDA may remove the content of the party suspected of infringement.

24. After the infringer receives the infringement notice sent by the GSIEDA, if the party believes that he/she has committed no infringement, he/she may reply notice document and request the GSIEDA to restore the content or related information that has been removed or made inaccessible to others. Once the GSIEDA receives the reply notice in the preceding paragraph, it will forward the reply notice document to you. You should submit to the GSIEDA the evidence of infringement within 10 working days after receiving the reply notice document forwarded by the GSIEDA; otherwise, the GSIEDA may restore the content that has been removed or made inaccessible to others within 14 working days from the day after forwarding the reply notice at the latest.

25. The reply notice under the Policy on Reporting Violation of Intellectual Property Rights should contain the following items and be signed or sealed by the suspected infringer (or his/her agent): 

(1) The name, address, telephone number, fax number and email address of the party (or his/her agent) suspected of infringement.

(2) If the reply notice is sent by the agent of the suspected infringer, a statement shall be sent indicating that agent has been entrusted by the suspected infringer and specifying the name or title of the suspected infringer.

(3) A statement requesting the GSIEDA to restore the removed or inaccessible content, and relevant information sufficient to make the GSIEDA aware of the content.

(4) A statement showing that the user is on good faith and believes that he/she has legal rights to use such content, and that the removal of the content or the inaccessibility for others are due to the false or incorrect statement made by the person (or his/her agent) who makes the infringement notice.

(5) Agrees that the GSIEDA will forward the reply notice to the person (or the agent) who made the infringement notice.

(6) Indicating that the suspected infringer is willing to bear legal responsibility if other parties suffer damages.

26. The rules on infringement notice in Article 22 and 23 apply to the submission and supplement of reply notice in Article 25 and 26, except when the GSIEDA believes that the use of email does not require an electronic signature.
